New York's highest court of appeals has held that no-fault insurers cannot deny no-fault benefits where they unilaterally determine that a provider has committed misconduct based upon alleged fraudulent conduct. The Court held that this authority belongs solely to state regulators, specifically New York's Board of Regents, which oversees professional licensing and discipline. This follows a similar recent ruling in Florida reported in this publication.
New COCSA Outreach
The Congress of Chiropractic State Associations (COCSA) Board recently voted to adopt the Scoliosis Awareness Program produced by the Scoliosis Care Foundation. COCSA will partner with the foundation in offering scoliosis educational materials to chiropractic state associations nationwide.
“[This is] a great opportunity for the chiropractic profession to partner with a nonprofit organization that is dedicated to the well-being of our children, and, together, to educate parents on the sometimes minor postural changes that could indicate a possible development of scoliosis,” commented Jeffrey Fedorko, DC, COCSA president.
