New York's highest court of appeals has held that no-fault insurers cannot deny no-fault benefits where they unilaterally determine that a provider has committed misconduct based upon alleged fraudulent conduct. The Court held that this authority belongs solely to state regulators, specifically New York's Board of Regents, which oversees professional licensing and discipline. This follows a similar recent ruling in Florida reported in this publication.

Don't Let MDs Kill the Chiropractic Medicare Coverage Modernization Act
With the latest iteration of the Chiropractic Medicare Coverage Modernization Act in the congressional pipeline, the medical profession is doing its best (as usual) to ensure the legislation goes nowhere. Case in point: the American College of Radiology and American Society of Neuroradiology’s recent joint letter to the cosponsors brought the total of medical organizations voicing opposition above 90 ... and counting.
The takeaway: It’s critical for the chiropractic profession – and each and every DC – to give Congress more reasons to pass the legislation than MD organizations are voicing against it. Visit www.congress.gov/members/find-your-member for a directory of Congress members by state ... and then contact yours to help convince them to ignore the MD hype and support Medicare coverage for doctors of chiropractic aligned with your scope of practice and the services you provide.
