New York's highest court of appeals has held that no-fault insurers cannot deny no-fault benefits where they unilaterally determine that a provider has committed misconduct based upon alleged fraudulent conduct. The Court held that this authority belongs solely to state regulators, specifically New York's Board of Regents, which oversees professional licensing and discipline. This follows a similar recent ruling in Florida reported in this publication.
NBCE Seats New Board, Elects Executive Committee at Annual Meeting
The National Board of Chiropractic Examiners (NBCE) held its Annual Meeting on April 26-30, 2010, in Baltimore to seat new board members and elect officers who make up the executive committee.
Dr. Robin Lecy (S.D.) and Dr. Donna Craft (Mich.) were seated as district directors for Districts I and II, respectively. Dr. Salvatore LaRusso (Fla.) was elected and Dr. Richard Cole (Tenn.) was re-elected to serve three-year terms as At-Large directors. Dr. Daniel Saint Germain (Quebec, Canada) and Dr. Lawrence O'Connor (N.J.) were seated as Federation of Chiropractic Licensing Board appointees.
The Executive Committee was then chosen, with Dr. Theodore Scott (Utah) elected president of the board; he also serves as District IV director. Dr. Norman Ouzts Jr. (S.C.) was elected vice-president; he continues to serve as District V director. Dr. Donna Craft was elected treasurer; she also serves as District II director. Dr. Paul Morin (Maine) was elected secretary; he will continue to serve as District III director.
