New York's highest court of appeals has held that no-fault insurers cannot deny no-fault benefits where they unilaterally determine that a provider has committed misconduct based upon alleged fraudulent conduct. The Court held that this authority belongs solely to state regulators, specifically New York's Board of Regents, which oversees professional licensing and discipline. This follows a similar recent ruling in Florida reported in this publication.
N.C. Governor: Kudos to Chiropractic
North Carolina Governor Pat McCrory is the latest state legislator to take the initiative in supporting the chiropractic profession during National Chiropractic Health Month, declaring October "Chiropractic Month" throughout the state. In his official proclamation, Gov. McCrory noted that NCHM 2015 "serves as a reminder to all North Carolinians that they can participate in #PainFreeNation [an American Chiropractic Association campaign supporting this year's NCHM activities], and highlights the important role Doctors of Chiropractic perform in the health care delivery system."
Gov. McCrory's Sept. 9 proclamation in advance of NCHM also emphasized that doctors of chiropractic are "physician-level providers" with educational standards "equivalent in classroom hours to allopathic and osteopathic medical schools"; and stated that DCs are "recognized worldwide for their pain-relieving, health-enhancing and injury-prevention services."
According to the ACA, the #Pain FreeNation campaign during National Chiropractic Health Month 2015 is "designed to help members of the profession take greater advantage of the use of social media to spread the word about the effectiveness of chiropractic services [and highlight] the issues surrounding the pain crisis in America, as well as chiropractic's ability to be a part of the solution."
