Bennett X-ray Appeals Court Decision

Bennett X-ray Corp. announced that it was appealing a Chicago Federal District Court decision that prevents the company from making any further use or distribution of research information gained from a study conducted by Drs. Guebert and Pirtle at Logan Chiropractic College. The two doctors tested a Bennett 100 kHz high frequency system and a Gendex 6 kHz system as part of a high frequency x-ray research project. Gendex, after initial review of the test results, asked the two doctors to retest the system after the company's factory had a chance to recalibrate the Gendex unit used in the study. The company provided Dr. Pirtle tickets to fly back to St. Louis for retesting, but Gendex later called off the retesting and initiated litigation. Said President of Bennett X-ray Cal Kleinman, "The hearing in Chicago was a trial by ambush. We had no prior notice and did not have the opportunity to present evidence from independent experts who, we believe, would support the Guebert and Pirtle research."
