Jury Rules Allstate Must Pay for Spinal Ultrasound
MELBOURNE, Florida -- On June 16th, a jury trial held in Brevard County, Florida ordered Allstate Insurance Company to pay for diagnostic spinal ultrasound as part of Personal Injury Protection (PIP) benefits under an automobile insurance policy. In a two and a half day trial, a six-member panel jury decided in the case that Sena Morty, as a parent of Lucinda Adorka (a minor vs. Allstate Insurance Company) that the diagnostic spinal ultrasound was a necessary medical service and must be paid under PIP law.
The case stems from a motor vehicle accident in which the plaintiff, Ms. Morty's daughter Lucinda Adorka, was injured. Ms. Morty filed for PIP benefits under Florida Statute section 627.736, with the belief all payments would be made on her behalf up to the contractual 80 percent.
