New York's highest court of appeals has held that no-fault insurers cannot deny no-fault benefits where they unilaterally determine that a provider has committed misconduct based upon alleged fraudulent conduct. The Court held that this authority belongs solely to state regulators, specifically New York's Board of Regents, which oversees professional licensing and discipline. This follows a similar recent ruling in Florida reported in this publication.
Correction
Beginning on the front page of the Jan. 15, 1996 issue, "The Uncrowned Champion," by Todd Narson, DC, CCSP, there is an editing error of gender and relationship. Corey Narson, DC, who along with Dr. Todd Narson treated boxer Lamar "Cochise" Murphy, is referred to throughout the article as Dr. Todd Narson's brother, when in fact Corey is Todd's wife! This is quite embarrassing and the editor(s) responsible has been slapped around. To Drs. Corey and Todd Narson, please accept our apologies.
